‘I’ or ‘me’ refers to Louise Green – The Artist
‘You’ or ‘your’ refers to you – The client
‘Portrait’ refers to the commissioned piece of artwork commissioned by you
Use of images and copyright
I ‘Louise Green’ retain the copyright of all artwork that I create.
Your finished portrait is for your display and enjoyment only or for gifting to someone else for their enjoyment. Under no circumstances should the portrait be copied, prints taken from, or used for any financial gain without the express permission of me, the artist. Posting on social media with reference to me or my work is permitted.
I retain the right to use the finished portrait image for promotional materials, social media and for display on my website. Images may also be used as prints for resale or use in other products such as calendars and other merchandise. If you do not wish your pet portrait to be used in this way, then you must let me know when you pay your deposit.
Feedback and comments made in emails or verbally may be used as testimonials on my website or in promotional material.
In all cases GDPR will be observed and no personal information will be divulged.
By passing a reference photo to me to produce a pet portrait, you are allowing me the right to use that image for publicity, I may use the photo on my website or social media or in promotional material to show alongside the finished portrait if required. It will not be reproduced for any other reason than this. If you do not wish your original photo to be used for this purpose then you must let me know when paying your deposit.
All objections to using the original photograph or finished portrait in the ways described above need to be sent in writing via email to allow me to keep your request on record.
Payments
You will be required to pay an initial 25% deposit once your portrait is agreed upon, to book your place on my list.
Website prices are a guide and your quote will be based on based on your requirements after detailed discussions.
A full refund of your deposit will be made if you change your mind within 14 days of paying your deposit, unless work has already begun on your pet portrait as agreed, in which case your deposit will be retained to cover any work already completed. All cancellations will be required in writing via email.
After 14 days your deposit is non-refundable. If you cancel once work has commenced on your portrait, you will be liable for the proportion of the work that has already been carried out. e.g if 50% of the portrait is complete, you will be required to pay 50% of the total cost of the portrait. This is to compensate me for the time taken in planning, admin, materials and time taken so far on the portrait.
Quotes will be valid from 12 months of paying your deposit. If work is completed before 12 months, the balance due will be as quoted (unless, there are significant agreed upon changes) if you delay your portrait for over 12 months then your balance payment will be calculated based on the prices advertised at the time of balance payment. You will be notified before I start your portrait if the price that you have been quoted has changed.
I reserve the right to increase my price list at any time.
Payment in full will be required before optional framing and shipping. Absolutely no artwork will be shipped before full payment has been received.
Payments will be required via bank transfer or via a secure Stripe payment link that I will email to you. At no point will I see or store your card details.
Balances are to be paid within 7 days of final notification of portrait completion unless arrangements have been specifically made to delay payment.
Payments are not subject to VAT
Non UK customers
All transactions will be priced in UK Stirling. Exchange rates may vary so I bear no responsibility for refund values that differ from the original amount paid due to a variation in exchange rate.
Some countries are subject to import taxes and additional charges. It is your responsibility if you are outside the UK to ensure that you are happy to pay any import tax or additional import charges. You will be responsible for paying them separately. I bear no responsibility for import taxes.
Changes to your portrait
My wish is for you to be 100% happy with your final portrait. An image of the finished portrait will be sent to you once completed, for your approval. At this stage you are entitled to make small amendments to the finished piece if required. I reserve the right to make an appropriate extra charge for any large changes that you may wish to make to cover my time.
Once you receive your portrait, you have 7 days to request any further changes. Your portrait will need to be sent back to me in its original packaging and you will bear the cost of postage to me and back to you after any amendments are made. Changes requested after 7 days will not be honoured as you will have been deemed to accept your portrait.
I aim to be able to rectify anything that you are not happy with but in the unlikely case that you are really not happy with the final portrait, you will receive a 50% refund and will be liable to pay the cost of return postage. Refunds will only be actioned once I am receipt of your returned portrait.
Postage
I endeavour to package your portrait with the utmost care and attention to ensure that it arrives with you safely and securely. I use a Royal Mail or Parcelforce tracked and signed for delivery within the UK. Outside the UK I will ship using Royal Mail but your parcel will be passed to the relevant partner courier service within your own country.
Unfortunately, though rare, there is a risk of damage or loss during shipping.
If your portrait arrives damaged, then you must take a photograph of both your portrait and any damaged packaging immediately as I will require photographic evidence in order to claim any insurance payment.
Depending on the extent of the damage you can return the portrait to me and a new portrait will be completed. I will endeavour to complete it as soon as I am able, though the timescale will depend on the commission list at the time. You will need to pay the initial cost of return using an agreed courier and will be re-imbursed for shipping once I have received compensation from the carrier. This can take several weeks and you may be asked to fill out additional paperwork to declare the damage.
If it is just the mount that is damaged, then I would suggest you change the mount for a new one as this is a fairly simple and cost effective solution. If you bear the cost of postage both ways, then I will be happy to remount your portrait.
Compensation for lost portraits will be refunded once claimed back from the Post office. This may take a few weeks.
I take liability for any damage or loss that occurs during shipping from me to your agreed address. I refuse any liability for any damage or loss caused via third party shipping. e.g you then posting it on to someone else as a gift.
Timescales
Pet portraits take a long time and as such, you may have to have to wait a certain amount of time before I am able to start your portrait. Your deposit will secure your place on my list and the price agreed for up to 12 months and you will be given an accurate timescale for when your portrait will be started. An estimate would be around 6 weeks from ordering but this may change according to demand. If you need your portrait earlier than this for a gift, then please let me know in your initial contact and I will see if I can help.
From time to time, I may close my list due to demand. You are then welcome to join my waiting list. You will be notified when I open my list again and given the opportunity to pay a deposit to secure a booking. This will be offered on a first come, first served basis to everyone on the waiting list.
There may be occasions where an agreed date can’t be fulfilled due to circumstances beyond my control. In this case you will be notified as soon as possible and a new date will be agreed. This is likely to just be a small overrun so should not significantly impact the timescale agreed.
If I am totally unable to complete your portrait due to unavoidable circumstances, you will receive a refund in full.
Prints
Any prints or original artworks that are purchased from my Etsy shop may vary slightly from the photographs shown in the listings or on this website. Every effort is made to match colours and represent the images accurately but due to printer colours and screen differences, they may differ slightly in real life and real light.
Artist's rights of refusal
I reserve the right to refuse a commission for any reason. I will explain my reasons in each case.
I reserve the right to terminate any work undertaken due to failure to abide by the terms outlined in this agreement, repeated rudeness, unreasonable demands, threatening language, behaviour or any kind of harassment.
In this case, you will not be entitled to a refund.
